The insurers are infringing three patents that related to vehicle monitoring and ways the monitoring is used to determine insurance rates, Progressive contends. Both complaints were filed yesterday in federal court in Cleveland.

The complaints target Hartford’s “TrueLane” and State Farm’s “Drive Safe & Save” initiatives. The programs get data regarding location, mileage, speed and other information from an onboard computer to calculate a “safety score” on the driver.

Progressive’s suits are nothing new, the company has already scrapped with Allstate and Liberty Mutual over similar situations, settling with AllState, but the case is pending with Liberty Mutual.

1. Infants (birth to one year of age or weighing at least 22 pounds) require a rear-facing convertible seat; always make sure the harness straps are at or below shoulder level and never place a rear-facing car seat in the front seat.
2. Toddlers (over one year of age and weighing 20-40 pounds) need a forward-facing convertible seat, with harness straps at or below shoulder level.
3. Young Children (ages 4 – 8 years, unless at least 4’8” tall and weighing more than 40 pounds) need a seat belt-positioning booster seat in a forward-facing seat position; the best positioning booster seats must be used with both lap and shoulder belts making sure the lap belt fits low and tight across the lap and upper thigh area, and that the shoulder belt fits snug crossing the chest and shoulder, to avoid abdominal injuries. Any Children 12 and younger should ride in the backseat at all times.

“This is an industry that had prepared for the end of the world and instead of the end of the world they are just getting somewhat of a sluggish economic recovery,” said Adam Jonas, a Morgan Stanley analyst who follows GM.

Most motorists are aware that seat belts and child safety seats can save lives; the National Highway Traffic Safety Administration estimates that over 15,000 lives are saved each year by proper seat belt use. Buckling up every time you drive or ride in a car makes good financial sense as well; failure to wear seat belts can lead to costly traffic tickets and fines and may raise auto insurance premiums as well. Seat belts are one of the easiest and most effective ways to protect yourself and your family when you’re out on the road.

While statistics indicate that 81% of all drivers and passengers buckle up faithfully every time, nearly 20% do not. The reasons given range from minor discomfort to forgetfulness to the short duration of the expected trip; some people even believe that seat belts can be dangerous in the event that the vehicle is submerged under water or engulfed in flames. In fact, less than one tenth of a percent of all automobile accidents involve deep water or sudden bursts of flames. Even in those rare cases, seat belts can protect drivers and passengers from impacts that can stun or render them unconscious and unable to react to save their own lives.

Statistics show that drivers who wear seat belts are more likely to maintain control of their vehicle in the event of an accident; this can prevent a chain reaction that can make an already bad situation far worse. When used every time, seat belts and child car seats can reduce the chance of fatal injury by nearly 50% and even lessen the severity of injuries sustained in the accident. The facts add up: wearing a seat belt can not only save you money on auto insurance and traffic tickets; seat belts can save your life and the lives of those you love.
