When it comes time for you to compare insurance rates, you may be surprised to learn that your auto insurance company wants to access your credit report in order to determine your insurance quote.  But, the reality is that many states do allow insurance companies to use their customers’ credit histories when determining the rates they will charge.  If you live in Michigan, however, this practice may soon come to an end.

According to recent reports, the state of Michigan denied the auto insurance rate increases that seven different companies attempted to make based on the credit history of the drivers.  Furthermore, the practice of using credit histories when determining insurance rates has been put to challenge within the Michigan court system.

Ken Ross, who is the state insurance commissioner, is reported as saying that he hopes the state’s denials of the rate increases will send a clear message to the insurance companies that using credit scoring unfairly discriminates against certain motorists.  On the other hand, the insurance companies believe looking at drivers’ credit scores is a good way to determine that person’s risk of filing a claim.  According to Lori Conarton, who is a spokesperson for the Michigan Insurance Institute, the practice of increasing the rates for those with poor credit also allows them to keep the rates lower for those who are at a lower risk for filing a claim.

The insurance companies do not have much backing in the state of Michigan when it comes to this theory, however, as Governor Jennifer Granholm has made it quite clear that she wants to see insurance rates go down within her state – particularly in Detroit and other urban areas.  In act, Granholm imposed a state ban on the practice in 2005, but the ban was challenged by the insurance industry and is currently being reviewed by the state Supreme Court.

The seven companies whose insurance rate increases were recently denied include:

· Allied Property 7 Casualty
· AMCO
· Farm Bureau General of Michigan
· Farm Bureau Mutual
· Frankenmuth Mutual
· Michigan Millers
· Progressive

According to Ross, the state could deny these increases because “Insurance credit scoring does not comply with Michigan law.”  He went on to say that insurance rates should be determined solely on factors that are related to driving and not on other personal issues such as a person’s credit history.  Yet, Jeffrey Junkas, who is a spokesman for the American Insurance Association’s Midwest Region, has reportedly said that Ross’s decision to deny the rate increases is irrational and politically motivated.  He also pointed out that Ross and Granholm have not challenged other personal issues unrelated to driving that are taken into account when determining a person’s insurance rates, such as giving discounts to students with good grades, to those who are married and to those who purchase several policies from the same company.  In response, Ross has stated that these “discounts” aren’t really discounts at all.  Rather, the insurance companies are simply setting their rates higher than necessary and then giving drivers certain “credits” in order to create the illusion of giving a discount.Purchase Ansaid
